In this CNN op-ed piece, actors Jim Carrey and Jenny McCarthy reflect on their son's recovery from autism in light of the recent federal court decision which conceded that vaccines could have contributed to another child's autistic condition.
Carrey and McCarthy's son, Evan, has been healed thanks to breakthroughs that may not be scientifically proven, but have definitely helped, such as a gluten-free, casein-free diet, vitamin supplementation, detox of metals, and anti-fungals for the yeast overgrowths that plagued his intestines. Once his neurological function was recovered through these medical treatments, speech therapy and applied behavior analysis helped him learn the skills he could not learn while he was frozen in autism.
When Evan was re-evaluated after these treatments, state workers were amazed by his improvement. But although Evan is now 5, not a single member of the CDC, the American Academy of Pediatrics, or any other health authority has asked to evaluate and understand how Evan recovered from autism. Instead, they simply posit that he was misdiagnosed and never had autism to begin with.
Carrey and McCarthy believe that autism is an environmental illness, and that while vaccines are not the only environmental trigger, they do play a major role. Senate HELP Committee one day after it was introduced "a drug company stockholder's dream and a consumer's worst nightmare." The proposed legislation will strip Americans of the right to a trial by jury if harmed by an experimental or licensed drug or vaccine that they are forced by government to take whenever federal health officials declare a public health emergency.
The legislation's architect,
Senator Richard Burr (R-NC), Chairman of the HELP Subcommittee on Bioterrorism and Public Health Preparedness, told the full HELP Committee yesterday that the legislation "creates a true partnership"
between the federal government, the pharmaceutical industry and academia to walk the drug companies "through the Valley of Death" in bringing a new vaccine or drug to market.
Burr said it will give the Department of Health and Human Services "additional authority and resources to partner with the private sector to rapidly develop drugs and vaccines." The Burr bill gives the Secretary of DHHS the sole
authority to decide whether a manufacturer violated laws mandating drug safety and bans citizens from challenging his decision in the civil court system. The bill establishes the Biomedical Advanced
Research and Development Agency (BARDA), as the single point of authority within the government for the advanced research and development of drugs and vaccines in response to bioterrorism and natural disease outbreaks such as the flu.
BARDA will operate in secret, exempt from the Freedom of Information Act and the Federal Advisory Committee Act, insuring that no evidence of injuries or deaths caused by drugs and vaccines labeled as "countermeasures" will become public. Nicknamed "Bioshield Two," the legislation is being pushed rapidly through Congress without time for voters to make their voices heard by their elected representatives.
Co-sponsored by Republican Senate Majority Leader Bill Frist (R-TN), Senate Health, Education, Labor and Pensions Committee Chairman Mike Enzi (R-WY), and Senate Budget Committee Chairman Judd Gregg (R-NH), the legislation will eliminate both regulatory and legal safeguards applied to vaccines as well as take away the right of children and adults harmed by vaccines and drugs to present their case in front of a jury in a civil court of law.
"It is a sad day for this nation when Congress is frightened and bullied into allowing one profit making industry to destroy the seventh Amendment to the Constitution guaranteeing citizens their day in court in front of a jury of their peers," said Barbara Loe Fisher, president of NVIC. "This proposed legislation, like the power and money grab by federal health officials and industry in the Homeland Security Act of 2002 and the Project Bioshield Act of 2004, is an unconstitutional attempt by some in Congress to give a taxpayer- funded handout to pharmaceutical companies for drugs and vaccines the government can force all citizens to use while absolving everyone connected from any responsibility for injuries and deaths which occur. It means that, if an American is injured by an experimental flu or anthrax vaccine he or she is mandated to take, that citizen will be banned from exercising the Constitutional right to a jury trial even if it is revealed that the vaccine maker engaged in criminal fraud and negligence in the manufacture of the vaccine."
The federal Food and Drug Administration (FDA) is legally responsible for regulating the pharmaceutical industry and ensuring that drugs and vaccines released to the public are safe and effective.
Drug companies marketing painkillers, like Vioxx, and anti-depressants, which have resulted in the deaths and injuries of thousands of children and adults, are being held accountable in civil court while the FDA has come under intense criticism for withholding information about the drugs' dangers from the public.
Since 1986, vaccine makers have been protected from most liability in civil court through the National Childhood Vaccine Injury Act in which Congress created a federal vaccine injury compensation program (VICP) that offers vaccine victims an alternative to the court system. Even though the program has awarded nearly $2 billion to victims of mandated vaccines, two out of three plaintiffs are turned away.
"The drug companies and doctors got all the liability protection they needed in 1986 but they are greedy and want more," said Fisher. "And the federal health agencies want more power to force citizens to use vaccines without having to worry about properly regulating them. If the Burr bill passes, all economic incentives to insure mandated vaccines are safe will be removed and the American people are facing a future where government can force them to take poorly regulated experimental drugs and vaccines labeled as "countermeasures" or go to jail. The only recourse for citizens will be to strike down mandatory vaccination laws so vaccines will be subject to the law of supply and demand in the marketplace. The health care consumer's cry will be: No liability? No mandates."

Defense Secretary Rumsfeld stands to get filthy rich on Tamiflu vaccine!

"No sooner are indictments being handed down to I Lewis 'Scooter' Libby, chief of staff of the vice president of the United States for lies and cover up regarding information used deliberately to suppress the fact the Bush administration had no 'smoking gun' to prove Saddam Hussein was building a nuclear arsenal, but a new scandal is surfacing, every bit as outrageous and ultimately, likely also criminal. The world population is being whipped into a fear frenzy by irresponsible public health officials from the US administration to the World Health Organization (WHO) to the United States Centers for Disease Control. They all warn about the imminent danger that the bird flu virus might mutate into a malicious strain that is transmissible between humans, contaminating the human species in pandemic proportions. Often the flu pandemic of 1918, which is said to have killed 18 million worldwide, is cited as an example of what 'might' lie in store for us."
"The only medicine, we are told, which reduces the symptoms of avian flu is a drug called Tamiflu. Today, Roche holds the sole license to manufacture Tamiflu. Due to the panic, the order books at Roche are filled to overflowing. However, the real point of interest is the company in California which developed Tamiflu and gave the marketing rights for its patented discovery to Roche. Tamiflu was developed and patented in 1996 by a California biotech firm, Gilead Sciences Inc. Gilead is a NASDAQ-listed stock company which prefers to maintain a low profile in the current rush to Tamiflu. That might be because of who is tied to Gilead. In 1997, before he became Pentagon chief, Donald Rumsfeld was named chairman of the board of Gilead Sciences, where he remained until early 2001 when he became defense secretary. Rumsfeld had been on the board of Gilead since 1988 ... Rumsfeld holds a Gilead stake valued at between $5 million and $25 million, according to his federal financial disclosures. In the past six months, the global rush to buy Tamiflu has sent Gilead's stock from $35 to $47 - amounting to a windfall of at least $1 million for Rumsfeld. And now, with Gilead collecting royalties averaging 10% from Roche's sales of Tamiflu, he is poised to reap more gains for a flu panic his administration has done everything it can to promote."
From now on, when you hear worthless public rhetoric urging you to take Tamiflu vaccine, you will remember that old "Rummy" is going to get very, very rich. To further enrich his Defense Secretary, President Bush proposed to spend almost $7 billion of budget-busting money to stock Tamiflu vaccine.

"Washington - Vaccine improvement is expected to take center stage in the Bush administration's preparations for a worldwide flu outbreak, with a potential travel ban and restrictions on global commerce part of the contingency planning. President Bush today will announce his strategy on how to prepare for the next flu pandemic - preparations expected to cost at least $6.5 billion - whether it is caused by the worrisome Asian bird flu or some other super-strain of influenza. States and cities will get their first specific instructions from federal health officials on making such decisions as who should get limited doses of vaccines and the antiviral medications Tamiflu or Relenza.
"Pandemics strike when the easy-to-mutate influenza virus shifts to a strain that people have never experienced before ... While it is impossible to say when the next super-flu will strike, concern is growing that the bird-flu strain known as H5N1 could trigger one if it mutates and starts spreading easily among people. Since 2003, at least 62 people in Southeast Asia have died from H5N1; most of them regularly handled poultry."
However, an Asia Times article points out that H5N1 virus has never, ever mutated so it could cross the species barrier to infect a human. All this hype is over a strain of bird flu which has not demonstrated any human crossover capability. Doesn't it seem ludicrous for the President to propose spending almost $7 billion to combat a flu strain which does not have any capability to infect humans?
Of course, such a proposal makes sense if you realize:
1) The President is out to make his buddies like Defense Secretary Rumsfeld very, very rich;
2) The bird flu does not have to actually cross the human species barrier; Mass Media conditioning only has to scare enough people to rush forward to take the very vaccine which will kill them. Remember, the Spanish Flu was spread by vaccination ("Vaccine, Not Virus, Responsible For Spanish Flu", Archives, Irish Examiner, 2003/05/08).

Dear _________: I respectfully request that you act to protect the rights of vaccine-injured children by opposing the unfair liability immunity giveaway proposed for drug companies. There are ten or more bills pending in Congress that contain language that severely limits the rights of children injured by vaccines. I am shocked to learn that one of these provisions may be slipped into proposed legislation the Appropriations Bills Conference Report- in a manner similar to the provisions snuck in the dead of night into the Homeland Security bill in 2002. If any of these provisions is enacted, a vaccine-injured child's right to have his or her day in court will be unnecessarily and unfairly taken away. Enactment of this legislation will be a dark day for the tradition of fair play and equity in the American justice system, not to mention that such action will violate the Seventh Amendments preservation of every Americans right to a jury trial. As a voter who cares deeply about children injured by vaccines, I oppose legislation that will provide unprecedented immunity to a vaccine industry that has caused tragic injury to some children. Such liability protection is unnecessary. There has been minimal number of vaccine lawsuits over the past 30 years - current laws adequately protect vaccine manufacturers. The apparent lack of vaccine manufacturing capacity in our country is not due to lawsuits but to other causes, such as the consolidation of pharmaceutical industry via merger and market factors that pose economic barriers to vaccine production. Liability concerns have little to do with vaccine manufacturing problems eminent public health experts like the NIHs Dr. Anthony Fauci and Dr. Walter Orenstein, formerly of the CDCs National Immunization Program, have said so. Liability is not the problem. In addition, representatives of biotechnology companies have through the use of the latest technology that eliminates dangerous protein contaminants vaccines can be produced more safely than through the methods used by the major drug companies. These biotech companies say that they do not need liability protection in order to move ahead to manufacture the new generation of safe vaccines. Biotech firms using new technology have sufficiently high confidence in the safety of their product that they are not worried about lawsuits. I urge you to place the interests of injured children above those of the pharmaceutical industry. Along with many of voters across the country, I am deeply concerned that should unnecessary liability protection be enacted vaccine manufacturers will cease to have an incentive to make their products safe. Here's what's happening: supporters of vaccine manufacturers are trying to slip a proposal through Congress that would provide unprecedented immunity to drug companies for any harm caused by deadly or defective drugs and vaccines - all under the pretense that it is needed to increase vaccine supplies.
Instead of calming the public's fears of bird flu, Congress and the drug industry are trying to capitalize on it, and they're willing to trade in your rights to increase the already record-breaking profits of the pharmaceutical
companies. If this proposal passes, victims of faulty or dangerous drugs will be left with no recourse, even in cases of gross negligence on the part of the pharmaceutical companies who produce the drugs. Please prevent this proposal from passing Congress.
The drug industry and its friends will tell you that litigation has caused a crisis in vaccine production - but that's just not true! Over the last two decades there have been fewer than a dozen reported flu vaccine lawsuits and experts agree that liability concerns are not affecting vaccine production.
In fact, limiting the liability of drug companies could actually make a pandemic worse by discouraging Americans from getting vaccinated. When Congress passed similar smallpox vaccine legislation, many first responders simply refused to get vaccinated.
While we certainly need to increase the amount of vaccine and drugs available we can not allow Congress to use public fear of bird flu as an excuse to allow unsafe and even dangerous drugs to be administered to patients. Act now!

The planning of US leadership, behind the scenes, can be discerned without extensive psychic ability. For example, "Disastrous Donald" made a killing of $5,000,000 on Tamiflu, since 2004.
"The firm made a loss in 2003, the year before concern about bird flu started. Then revenues from Tamiflu almost quadrupled, to $44.6m, helping put the company well into the black. Sales almost quadrupled again, to $161.6m last year. During this time the share price trebled."

We remind ourselves that, several months after the 2003, end-of-year financial summary was released by "Gilead Sciences," approx. five hundred samples of H5N1 were unscrupulously sent to various labs, around the world. Some samples "were lost." Shipments were allegedly concluded in Fall 2005, after various, reputable biophysicists and physicians "raised a stink" about the stupidity of the action. At this same time, the CDC (in Atlanta) and the WHO (allover) initiated the "Avian Flu" or "bird flu" hype on TV, then newspapers. Shortly thereafter, the more stupid among allopathic physicians began to attempt to capitalize on the hype. Various pharma companies, holding up to three years "back-up" of alleged "flu innoculation" began to publicize their "immediate capabilities."

Babys given the new five-in-one jab face a risk of convulsions, brain damage or even death.
Results of medical trials by the firm which makes the vaccine have revealed that the "superdose" vaccination, which was introduced 18 months ago, can have serious side-effects.
The five-in-one is designed to protect children against diphtheria, tetanus, whooping cough, Hib influenza and polio in a single shot.
Evidence from the vaccine's manufacturers, Sanofi Pasteur, shows that in clinical trials 64 per cent of 451 babies given the Pediacel jab experienced bad reactions. Ten per cent of these were "moderate to severe."
These included convulsions, loss of consciousness and high-pitched or persistent inconsolable crying.
Other studies showed that components of the vaccine can cause breathing difficulties, blue discolouration of the skin due to lack of oxygen, swelling of the brain, low blood pressure and extreme allergic shock.
The document prepared for the Medicines Healthcare Regulatory Authority and publicised by What Doctors Don't Tell You, a monthly newsletter that questions conventional medicine, has angered doctors and MPs. Professor Steve Webb, Liberal Democrat health spokesman, criticised the Government saying: "I am very concerned that these apparently wide spread side-effects have not been disclosed. The Government should investigate these concerns urgently."
Dr Richard Halvorsen, a London GP who specialises in innoculations said: "I'm concerned that this five-in-one is overloading a child's immune system."
"The risks of vaccinations have been played down by the Government and parents have been fobbed off with bland reassurances." (Of Course, their most likely reassurance against side effects is that the "Patient responded poorly to treatment, so it's not the Vaccine's fault...")
And Dr Peter Mansfield, who won a case against the doctor's governing body, the General Medical Council, for refusing to give the combined controversial measles, mumps and rubella to infants, said: "This is scandalous. We're vaccinating babies when their immune systems are not ready."
Jackie Fletcher from the vaccine damage support group JABS, is also concerned. She said: "The Department of Health is failing to acknowledge the dangers of the vaccines and the damage they can cause. It claims the five-in-one is perfectly safe, but clearly it is not.
"The only person taking a risk here is the baby and parents are not being given correct information about it."
Health officials claim it is safer than the four-in-one-jab it replaced which contained the controversial preservative mercury, which has been linked with autism. The new jab is also deemed to be safer because it contains inactivated polio to remove the risk that children could contract polio paralysis from the old oral vaccine that contained a live sample of the virus.
However, the revelations will ignite debate about the over-use of innoculations and could hinder Government plans to bring in an even more intensive vaccination programme that will see children receiving 25 vaccines in 12 injections by the time they are two.
The new proposed schedule contains the controversial MMR jab, the five-in-one jab, a new pneumococcal vaccine and the meningitis C vaccine.
When the five-in-one was launched the Government vaccine chief urged parents: "Please do not delay having your child vaccinated. Our vaccines are extremely safe."
Nicholas Kitchin, medical director of Sanofi Pasteur, insisted: "There are fewer side-effects with the five-in-one than were reported with the older four-in-one vaccine.
"All drugs and vaccines have potential side-effects, which parents should be aware of and these are listed in the information leaflet included with every dose of the vaccine. Severe reactions are rare and the benefits of vaccination far outweigh the risks."
A spokeswoman for the Department of Health added: "The Joint Committee on Vaccination and Immunisation thoroughly assesses the evidence on the safety and efficacy of all new vaccines before they are added to the childhood immunisation programme. Pediacel has an excellent record.
"Every parent is informed about the potential side effects of every vaccine in a guide which is given to parents by health visitors."

The Government must move fast to prove that its new super-drug is completely safe for British babies. The five-in-one vaccination, introduced 18 months ago, was claimed to be a major breakthrough in the fight against childhood killer diseases. The drug, which is intended to provide protection against polio, diphtheria, whooping cough, tetanus and meningitis, is given to babies as young as two months and was claimed to be risk-free.
But evidence collected by the drug's manufacturer tells a different story.
The Sunday Express has revealed that the maker's clinical trials showed that nearly two out of three infants given an injection of its super jab experienced significant side effects.
The trials, when linked with other data, revealed a danger that children could suffer convulsions and even run the risk of brain damage.
This is devastating news for parents. Some health campaigners warn that the combination of five powerful vaccines adminstered in this way overwhelms a baby's immune system.
It is vital that the Department of Health intervenes now to restore public confidence. Every parent knows that no threat to a baby's health is ever tolerable.
